Overview

A sportsbook can be legal in New Jersey and unavailable to the same customer a few miles away in another state. No US sportsbook license covers all 50 states.

Since the Supreme Court overturned the federal PASPA restriction in 2018, states have built separate markets. Missouri joined them on December 1, 2025. Bettors must be 21 or older and physically inside the state.

Your location matters more than your home address

Legal online sportsbooks check where a device is located when a bet is submitted. New York's rules require geolocation systems to reject wagers placed outside state borders and detect attempts to manipulate location data.

Visitors may qualify without living in the state, but crossing its border can stop wagers even when the account remains accessible.

Age limits vary; 21 is common but not universal.

Check the license, not the logo

The New Jersey Division of Gaming Enforcement publishes its authorized online sports pools. Massachusetts also maintains a list of licensed operators and an official seal for approved platforms.

Check the legal company, state license and exact website before depositing. An offshore bookmaker advertising to Americans is not necessarily authorized in the state where the customer is located.

There are also differences within legal markets. New York prohibits proposition bets tied to individual college athletes. A familiar sportsbook may therefore offer different markets across states.

An attractive offer can hide expensive conditions

Two sportsbooks may display the same NFL game at different odds. A $100 winning wager at -110 returns about $190.91 including the stake; at -120 it returns about $183.33. Regular price differences can outweigh a one-time promotion.

Check whether bonus bets return the stake, which bets qualify and when rewards expire. For withdrawals, confirm bank-transfer options and whether the payment method receives funds. KYC (Know Your Customer identity verification) is a normal part of regulated account checks.

Tax policy can affect the market too. Illinois began charging licensed online operators an additional $0.25 per wager in July 2025, rising to $0.50 after 20 million annual wagers. This is an operator tax, not a universal charge deducted directly from every player's ticket.

Federal gambling taxes changed in 2026

Sports betting winnings are generally reportable for US federal income tax purposes, even when no Form W-2G is issued.

From tax year 2026, gamblers who itemize deductions can generally deduct only 90% of their wagering losses, and never more than their winnings. Someone reporting $10,000 in wins and $10,000 in losses could therefore have $1,000 in net taxable gambling income under that calculation, despite breaking even overall. States may also tax winnings.

FAQ

Questions about betting in USA

Are online betting sites legal everywhere in the USA?

No. Each state determines whether online sportsbooks can operate and which companies receive licenses. Some jurisdictions permit only in-person wagering or none at all.

Can I bet while visiting another state?

Often yes, if online sports betting is legal where you are physically located and you meet the operator's requirements. VPNs cannot satisfy official location checks.

Are offshore sportsbooks the same as US sportsbooks?

No. Offshore operators may hold licenses abroad, while legal domestic sportsbooks operate under specific US state authorizations. Consumer protections and complaint procedures can differ substantially.
